TERMS AND CONDITIONS FOR ISSUANCE OF PLUXEECAMPUS SOLUTION TO CONSUMER
These Terms and Conditions (“Terms and Conditions”) apply to and regulate the Campus Solution provided by Pluxee India Private Limited (“Pluxee”) (formerly known as Sodexo SVC India Private Limtied). These Terms and Conditions shall be in addition to and not in derogation to any other terms as stipulated by Pluxee, from time to time.
The Students of the Educational institution whose details Pluxee have received from the Education Institution shall be issued Pluxee Card or NFC Tag as may be instructed but the same will be activated post completion of onboarding formalities, in case student is a minor the same needs to be completed by the Parent.
The detailed terms and conditions governing operation of Pluxee Card are as under;
Definitions
‘Applicant’ shall mean the person who makes an application by submitting the Application Form for issuance by Pluxee Campus Solution to the Student, the Applicant needs to be above 18 years of age.
‘-Benefits ’ is a package of benefits services (other than Meal) offered by Pluxee to the Consumers that can be used at the Merchant within the Educational Institution premises or at such other place advised by the Educational Institution.
‘Consumer’ shall mean the student to whom Campus Solution has been issued based on the instructions from the Educational Institution
‘Card’ shall mean a Hybrid card that is combination of Meal and Benefits issued by Pluxee in physical form or virtual form as may be requested by the Educational Institution.
‘Educational Institution’ shall mean the school as mentioned on the application form where the Consumer has been enrolled for studies.
‘Hybrid Card’ is a single card that is combination of Meal and Benefit issued by Pluxee whereby the Meal may be used through the Mag Stripe option at Merchant Network only for purchase of food and non-alcoholic beverages and the Benefits may be used for other products or services.
‘Meal’ is a meal benefit service offered by Pluxee through the issuance of meal instrument for purchase of food and non-alcoholic beverages from the Pluxee Merchant.
‘Merchant' shall mean any person or entity that has an agreement with Pluxee to accept Card against purchase of food and non-alcoholic beverages within the premises of the Educational Institution only or for sale of other products as may be permissible.
‘Mobile App’ is a software application which allows a Applicant to view and manage their account using their mobile device.
‘NFC Tag’ is a sticker or wristband with small microchips that can be read by in range mobile device and can be used only for acceptance of food and non-alcoholic beverages.
‘Campus Solution’ shall mean Card provided by Pluxee to the Consumer that can be used only within the campus pursuant to this terms and conditions.
PURPOSE
Pluxee will issue Campus Solution through issuance of Hybrid to the Consumer basis the acceptance of the terms and conditions by the Applicant and the same can be used at the Merchant through NFC tag facility or Card. The Meal will be a part of Hybrid Card (combination of Meal and Benefits) that will be issued by Pluxee, wherein only Meal / Benefits as availed by the Applicant or Educational Institution will be enabled on the Hybrid Card.
As per the applicable Reserve Bank of India guideline on the Issuance and Operation of Pre-paid Instruments in India dated April 27, 2009 and its amendment thereto, the maximum balance on a pre-paid card with Minimum KYC cannot exceed Rupee Ten Thousand (₹ 10,000) or such other amount as prescribed by RBI from time to time. Therefore the Applicant hereby acknowledges and agrees that the Meal with Minimum KYC shall not, at any point of time, be loaded or reloaded by Pluxee, for an amount exceeding ₹ Ten thousand (₹ 10,000).
ACTIVATION OF CARD
- The Applicant agrees that the Card issued will be in inactive mode and the same can be activated post;
- Providing the KYC information as mandated by regulatory authorities from time to time
- In case the Consumer is a minor, the KYC information and mobile number of the Parent needs to be provided at the time of activation of Card
- Successful OTP bases verification of mobile number
- Acceptance of Consumer Terms and Conditions by the Applicant as mentioned on the website before activation of the card.
LOADING/ RE-LOADING THE CARD
- As the Card/ NFC Tag is being issued to the Consumer as part of the arrangement entered into by and between the Educational Institution and Pluxee, the Applicant or the Educational Institution shall be entitled to load and/or re-load the Meal or other Benefits as may be availed by the Applicant/ Educational Institution..
- The funds can be loaded on the Card only through UPI. Pluxee doesn’t permit loading of Card through Cash. There shall be no interest payable by Pluxee on the balances lying in the Wallet/ Card of the Consumer.
MEAL AND OTHER BENEFITS
- The balance on the Meal Benefit or NFC Tag can only be used for purchase of Food and Non Acloholic beverages at the Merchant. The other Benefits through physical card can be used to make payments on other spends in campus or its vicinity as may be advised by the Educational Institution. Any dispute regarding the quality of products or services purchased shall be referred directly to the Merchant without any reference to Pluxee.
- Once the Card and/ or NFC tag is provided as per the agreed terms, Pluxee will not be liable if the NFC tag/ Card is destroyed, damaged or stolen regardless of whether it has been used or not.
- The Card or the NFC Tag is non-transferrable and should not be assigned or transferred to anyone other than to the the Consume by the Applicant. Any Card assigned, sold or otherwise transferred in violation of this provision may be invalidated or cancelled.
- The Card issued by Pluxee does not facilitate balance transfer or cash withdrawal.
- If the Consumer is no longer part of the Educational Institution, the balance lying on the Card/ wallet can be refunded as permissible by RBI under Payment and Settlement Systems Act, 2007 and its Directions issued thereto.
- Lost or Stolen Meal/ NFC Tag: In case the Card is misplaced/ stolen, the Consumer can block the card and untrust the Merchant using the Pluxee- India App and the transaction will not be completed without providing the PIN number.
- The Consumer will need to refer and comply with the Consumer terms and conditions available on our website Pluxee.in
LIABILITY
- The Merchant shall solely be responsible for the products and services sold by the Merchant to the Consumer. It is distinctly understood that Pluxee bears no responsibility for the products and services sold by the Merchant.
- In no event shall 'Pluxee' be liable for any direct, indirect, punitive, incidental, special, consequential damages or any other damages whatsoever including, without limitation, damages with regards to the quality of food or non-alcoholic beverages purchased by the Consumer including consumer experience or with regards to arrangement covered herein.
REGULATORY
- The Card is classified as Payment Instrument as defined under the Issuance and Operation of Pre-Paid Payment Instruments in India (Reserve Bank) Directions, which is governed by the Payment and Settlement Systems Act, 2007 ('PSS Act, 2007') as may be amended from time to time. All relevant Regulations will be binding on the Issuer, Applicant, Merchant and the Consumer as applicable from time to time.
- In compliance with RBI directions issued under PSS Act, 2007, the amount received for loading the Card/ NFC Tag is deposited in an Escrow Account with the Bank, to ensure honouring of payments against Valid Card/NFC Tag transactions to the Merchant.
- The Applicant agrees to provide Pluxee with necessary information/documents as may be required to comply with Know Your Customer / Anti - Money Laundering & Combating Financial Terrorism Guidelines issued by RBI including any amendments thereto.
- If any Dispute arising between the parties is not amicably settled within Thirty (30) days of commencement of attempts to settle the same, the Disputes shall be referred for arbitration under the provisions of the Indian Arbitration and Conciliation Act 1996 by mutually appointing one Arbitrator and the arbitration proceeding shall be held in Mumbai in English language.
- This Contract will be construed in accordance with and governed by the Laws of India and each party agrees to submit to the exclusive jurisdiction of the courts in Mumbai, India.
